Terms of service
These terms apply when you buy from cpapmasks.co.uk. Please read them before ordering. Nothing in these terms affects your statutory rights as a consumer.
1. Who we are
cpapmasks.co.uk is operated by Sefam Medical Ltd, a company registered in England and Wales (company number 13500192), registered office Unit 6 Blackthorn Way, Five Mile Business Park, Lincoln, LN4 1BF, United Kingdom. VAT number GB 385 882 538. You can reach us at customerserviceuk@sefam-medical.com.
2. Our products
We supply CPAP masks and accessories for use with continuous positive airway pressure therapy. These are medical devices intended for use with therapy prescribed and supervised by a qualified clinician.
Nothing on this website is medical advice, and our size guides and product information are not a substitute for assessment by your sleep clinic or clinician. If you are unsure whether a product is suitable for you, speak to your clinician before ordering. If you are under the care of a sleep service, we recommend sharing your chosen size with them.
3. Placing an order
Adding items to your basket and completing checkout is an offer to buy. A contract is formed only when we send you an email confirming that your order has been dispatched. If we cannot accept your order — for example because an item is out of stock or incorrectly priced — we will tell you and refund any payment taken.
4. Prices and VAT relief
Prices shown on this website are zero-rated for VAT. Products of this type may be supplied VAT-free to a customer who is chronically sick or disabled and is buying them for their own personal or domestic use, under Group 12 of Schedule 8 to the Value Added Tax Act 1994.
Because of this, you are asked to complete an eligibility declaration in the basket before checkout. This is an HMRC requirement, not an optional step, and we are required to retain the declaration. Knowingly making a false declaration is an offence.
If you are not eligible for VAT relief, please do not complete the declaration. Contact us at customerserviceuk@sefam-medical.com and we will raise your order with VAT applied at the standard rate.
Prices are in pounds sterling and exclude delivery, which is shown separately at checkout. We may change prices at any time, but changes will not affect an order we have already accepted.
5. Payment
Payment is taken at checkout through Shopify Payments and the other methods shown at the point of sale. We do not store your card details.
6. Delivery
Delivery costs and timescales are set out in our Shipping policy, which forms part of these terms. Risk in the goods passes to you on delivery.
7. Cancellation and returns
You have the right to cancel within 30 days, and there is an important exception for products sealed for hygiene reasons. Both are set out in full in our Return and refund policy, which forms part of these terms. Please read it before opening a mask.
8. Faulty goods
Under the Consumer Rights Act 2015 the goods we supply must be of satisfactory quality, fit for purpose and as described. If they are not, contact us and we will put it right. Your statutory remedies are explained in our Return and refund policy.
9. Our liability
We are responsible for loss or damage you suffer that is a foreseeable result of our breaking these terms or failing to use reasonable care and skill. We do not exclude or limit our liability in any way where it would be unlawful to do so, including liability for death or personal injury caused by our negligence, for fraud, or for breach of your statutory rights.
We are not liable for loss or damage arising from use of a product other than in accordance with the manufacturer's instructions or your clinician's advice.
10. Events outside our control
We are not liable for delays or failures caused by events outside our reasonable control. If such an event occurs we will contact you and either extend the delivery timescale or, if the delay is substantial, allow you to cancel for a full refund.
11. Complaints
If something has gone wrong, email customerserviceuk@sefam-medical.com and we will acknowledge your complaint and work with you to resolve it. If we cannot resolve it between us, you retain the right to bring court proceedings.
12. Changes to these terms
We may update these terms from time to time. The version in force is the one published on this page when you place your order.
13. Governing law
These terms are governed by the law of England and Wales. If you live in Scotland or Northern Ireland you may bring proceedings in your local courts.
